Welcome to SparkOS, the creativity intelligence platform by Chase & Marshal Limited. These Terms of Service govern your use of our platform and services. Please read them carefully before using SparkOS.

Acceptance of Terms

  • By accessing or using SparkOS, you agree to be bound by these Terms of Service
  • If you do not agree to these terms, you must not use our services
  • We may update these terms from time to time; continued use constitutes acceptance
  • You must be at least 18 years old to create an account
  • You are responsible for maintaining the confidentiality of your account credentials

Service Description

  • SparkOS is a creativity intelligence platform offering assessments, idea validation, and coaching tools
  • Features vary by subscription tier (Free, Intermediate, Pro, Enterprise)
  • We reserve the right to modify, suspend, or discontinue features with reasonable notice
  • Service availability is provided on an 'as is' basis without guaranteed uptime
  • AI-powered features use machine learning and may produce varied results

Subscriptions & Payments

  • Paid subscriptions are billed monthly or annually as selected
  • Prices are in NZD unless otherwise stated and exclude applicable taxes
  • Free tier: Limited to 3 ideas with basic features
  • Intermediate tier: $24.50/month - Unlimited ideas and Priority Matrix
  • Pro tier: $49.50/month - Includes ECHO Co-Pilot and Creativity Lab
  • Enterprise tier: $114.50/month - Full access including 7Ps Audit and 5 team seats
  • Additional team seats available for Pro ($19/month) and Enterprise ($34.50/month)
  • Subscriptions renew automatically unless cancelled before the renewal date

Cancellation & Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of your current billing period
  • No partial refunds are provided for unused portions of subscription periods
  • Refund requests for exceptional circumstances may be considered on a case-by-case basis
  • Upon cancellation, you retain access until your paid period expires
  • Your data remains available for export for 30 days after account closure

Intellectual Property

  • SparkOS, including its design, features, and content, is owned by Chase & Marshal Limited
  • You retain ownership of ideas and content you create within SparkOS
  • By using SparkOS, you grant us a licence to process your content to provide our services
  • You may not copy, modify, or distribute SparkOS software or proprietary methodologies
  • The Brick Test, IDEAL framework, ECHO, and FuseHead are proprietary to Chase & Marshal
  • Feedback you provide may be used to improve our services without compensation

Prohibited Conduct

  • Using SparkOS for any unlawful purpose or to violate any laws
  • Attempting to gain unauthorised access to other users' accounts or data
  • Interfering with or disrupting the service or its infrastructure
  • Uploading malicious code, viruses, or harmful content
  • Using automated tools to scrape or extract data from SparkOS
  • Impersonating others or providing false account information
  • Sharing account credentials or allowing unauthorised access
  • Using the service in ways that could harm Chase & Marshal's reputation

Limitation of Liability

  • SparkOS is provided 'as is' without warranties of any kind
  • We do not guarantee specific outcomes from using our creativity tools
  • AI-generated insights are for informational purposes and should not replace professional advice
  • Chase & Marshal shall not be liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount paid for your subscription in the past 12 months
  • Some jurisdictions do not allow liability limitations; these terms apply to the fullest extent permitted

These terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
